Terms of Service
Last updated: October 13, 2026
Please read these Terms of Service (“Terms”) carefully before using the Sagius mobile application or the website at sagius.app (together, the “Service”) operated by Gabriel Marchesan Almeida (“us”, “we”, or “our”).
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.
1. Acceptance of Terms
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service. These Terms constitute a legally binding agreement between you and Gabriel Marchesan Almeida.
2. License to Use
We grant you a limited, non-exclusive, non-transferable, and revocable license to use the Service for your personal, non-commercial purposes. This license does not include any resale or commercial use of the Service or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of this Service or its contents; or any use of data mining, robots, or similar data gathering and extraction tools.
3. Credit Packs and Purchases
Sagius offers credit packs as one-time, consumable in-app purchases. Credits are used for AI-powered features such as philosopher chat and AI-generated quotes. All purchases are processed through Apple's App Store or Google Play, and are subject to their respective terms and conditions.
Credits are non-refundable once purchased, except as required by applicable law. Purchased credits never expire and remain in your account until used. Credit balances are non-transferable between accounts.
Subscriptions
Sagius also offers optional auto-renewable subscriptions (monthly or annual). An active subscription unlocks every daily quote and the full philosopher library and includes an allowance of AI credits for each billing period. Subscriptions renew automatically at the end of each period unless cancelled at least 24 hours before it ends; payment is charged to your App Store or Google Play account.
You can cancel at any time in your App Store or Google Play subscription settings. Cancelling stops future renewals; you keep access until the end of the current period. Credit packs remain one-time purchases and never renew.
4. Free Credits
New users receive a one-time grant of 10 free credits upon creating an account. These free credits are subject to the same terms as purchased credits and do not expire. No additional free credits are granted on a recurring basis. Exception: if you cancel a free trial before it ends, up to 10 free credits matching what you used during the trial are removed together with the trial credits. Purchased credit packs are never removed.
5. User Conduct
You agree not to use the Service:
- In any way that violates any applicable national or international law or regulation.
- To transmit, or procure the sending of, any unsolicited or unauthorized advertising or promotional material.
- To impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity.
- To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service.
- To attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service.
6. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of Gabriel Marchesan Almeida and its licensors. The Service is protected by copyright, trademark, and other laws of both Germany and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Gabriel Marchesan Almeida.
The philosophy quotes contained in the application are sourced from historical public domain works. While the curation, translation, and presentation are proprietary, the underlying philosophical texts are generally in the public domain.
7. Disclaimer of Warranties
The Service is provided on an “AS IS” and “AS AVAILABLE” basis without any warranties of any kind, either express or implied. Gabriel Marchesan Almeida makes no warranty that the Service will meet your requirements or be available on an uninterrupted, secure, or error-free basis. Gabriel Marchesan Almeida makes no warranty regarding the quality, accuracy, timeliness, truthfulness, completeness, or reliability of any content.
8. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Gabriel Marchesan Almeida, its affiliates, agents, directors, employees, suppliers, or licensors be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to the use of, or inability to use, the Service.
9. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.
10. Governing Law
These Terms are governed by the laws of the Federal Republic of Germany. If you are a consumer, this choice of law does not deprive you of the protection afforded to you by the mandatory provisions of the law of the country in which you have your habitual residence.
If you are a consumer, the courts designated by law have jurisdiction: you may bring proceedings against us in the courts of the country in which you are domiciled or in Germany, and we may bring proceedings against you only in the courts of the country in which you are domiciled. If you are a merchant (Kaufmann), a legal entity under public law or a special fund under public law, the courts competent for the operator's business address (see the Impressum) have exclusive jurisdiction; the same applies, to the extent permitted by law, if you use the Service in the course of a commercial or independent professional activity.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
11. Changes to Terms
We may update these Terms. We will notify you of material changes in the app or by e-mail before they take effect. If you do not agree to the changes, you may stop using the Service and delete your account.
12. Credit Packs and Pricing
Sagius offers the following credit packs:
- Taste: 30 credits
- Starter: 100 credits
- Explorer: 200 credits
- Thinker: 500 credits
- Philosopher: 1,000 credits
All credit pack purchases are one-time, consumable transactions. Credits do not expire. Prices may vary by region and are displayed in your local currency within the App Store or Google Play Store. Refund requests must be directed to Apple or Google, respectively, in accordance with their refund policies.
13. Right of Withdrawal (Widerrufsbelehrung)
If you are a consumer in the European Union, you have the right to withdraw from a digital content purchase within 14 days of the transaction without giving any reason.
However, by initiating a download or beginning to use credit-based features, you expressly consent to the performance of the contract beginning during the withdrawal period. You acknowledge that you thereby lose your right of withdrawal once the digital content has been fully provided (in accordance with §356(5) BGB and Art. 16(m) of Directive 2011/83/EU).
For credit pack purchases, the right of withdrawal applies to unused credits only. To exercise your right of withdrawal, please contact us at contact@sagius.app within 14 days of the purchase date, or request a refund through Apple or Google.
14. EU Online Dispute Resolution
In accordance with Regulation (EU) No 524/2013, the European Commission provides an online dispute resolution (ODR) platform, available at: https://ec.europa.eu/consumers/odr
Our email address for the purposes of the ODR platform is contact@sagius.app. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
15. Philosopher quiz
Sagius may offer a “which philosopher are you?” quiz on the website and in the app. Your result is shareable as a public page that names only the matched philosopher — not you. Raw answers are not stored. Completing the quiz does not create an account.
16. Information and erasure (GDPR Art. 13 and Art. 17)
When we collect personal data (account, purchases, support), Art. 13 GDPR requires us to tell you who the controller is, why we process the data, and which rights you have. Those details are in the Privacy Policy on sagius.app. The controller is Gabriel Marchesan Almeida, Freiberufler, Greven, Germany.
Approximate location. When you use the App, our server derives an approximate city, region and country from your IP address and stores it on your account; we never store the IP address itself, never use GPS and never ask for location permission. Details in the Privacy Policy (“Profile and Region Data”).
Under Art. 17 GDPR you may request erasure of personal data we hold about you (“right to be forgotten”), including an account and any quiz-related record that can identify you. Email contact@sagius.app. We respond within 30 days. Raw quiz answers are not stored, so there is nothing to erase for those answers.
